was introduced by the Governor on February 8th 1882, without any reference whatever to me.
Upon the draft Ordinance
in the Office of the Clerk of Councils there is a note signed by M Phillipps stating that the proposed Ordinance adapted from the English Act of 39 and 40 Victoria. Probably at the time when he prepared it the Aet 42 and 43 Victoria Cap: // had not been passed
This latter act would seem to be the proper
one to adopt here, and not the repealed Act.

I have examined the
accompanying Ordinance bring
An Ordinance enacted by the Governor of Hongkong, with the
advice of the Legiolative Council there of, entitled The Banishment
and Conditional Pardons Ordinance,
1882
and I am of opinion that the Ordinance is one which is not contrary to the Governor's Instructions.
